Terms of Use for ORBITING

These Terms & Conditions (“Terms”) of use of our platform ORBITING, our application (“Site”) and services in connection with the Site (sometimes herein referred to as “Services”) are between Yobiting Infotech Pvt. Ltd./ ORBITING (“We/Us/Our/Company/Service Provider”) and its Users  (“User/You/Your/Yourself/Service Recipient”).

Your use/access of the Site and Services through any means shall signify Your acceptance of the Terms and Your agreement to be legally bound by the same. If you do not agree with the Terms/ Advertising Policy or the Privacy Policy, please do not use the Site or avail Our Services.

The services are rendered by Orbiting that is provided to you by Yobiting Infotech Pvt. Ltd. These Terms of Use therefore constitute an agreement between you and Yobiting Infotech Pvt. Ltd.

This document is an electronic record in terms of Information Technology Act, 2000, and applicable cyber laws of other nations where we exist and rules made there under, as applicable. This electronic record is generated by a computer system and does not require any physical or digital signature.

DEFINITIONS:

1. “ORBITING” shall mean and include an online social platform for sharing Pictures, Videos, Content, Graphics etc. which is a Yobiting Infotech Pvt. Ltd.’s initiative towards providing platform for social sharing and communicating with people.
2. “Applicable Laws” shall mean and include any applicable and relevant law, statute, rule, regulation, ordinances, treaty, judicial precedent, order, judgment, decree, injunction, permit or decision of government of nations where the User resides, court or other legislative body, having jurisdiction over or otherwise governing these presents, as may be in force from time to time, without regard to conflict of law principles.
3. “User” shall mean and include individuals, associations, company, partnership institutions, organizations, entities, whether registered or not, approached Us through our Site to receive our services as displayed on the Site.
4. “Information” shall mean and include the data/information which may be provided by the User while registering with Us through creation of online account and such data/ information provided while visiting our Site, including but not limiting to:

• Personally Identifiable Information (hereinafter referred to as “Personally Identifiable Information /PII”) including but not limited to: Your name, address, age and date of birth, Your gender, marital status, Your e-mail address, Your contact number, any Government recognized ID like Passport Number, Aadhar No./ PAN, etc.

1. “Content” shall mean and include everything that is displayed/uploaded/posted and written on our platform.
2. “Sponsors” shall mean and include all the parties who have patronized for ORBITING and whose names are displayed on our platform as sponsors.
3. “User Account” shall mean and include a basic account which is free of any cost and anyone can log in by registering on our platform.

The use of Our Site and Services is subject to the following terms of use:

1. Object

Our Site, is a social platform for sharing/posting/uploading images, videos, stories, status and thoughts along with them as captions. It is accessible to everyone who intends to use it except the people disqualified by law of the nation where they’re residing/accessing the platform. The person using it should be above the age of 13 years. The Service includes all of the Orbiting products, features, applications, services, technologies, and software that we provide.
